Neutradol Competition in Poundland Limited Stores - CLOSING DATE: 29 February 2012

 

1.    What is this Competition? This is a Neutradol competition run in-stores of Poundland Limited (Poundland) in England, Scotland and Wales only and promoted by M S George Limited of Merevale House, Parkshot, Richmond TW9 2RG (the Promoter). The Promoter will use a Specialist Handling Company to manage the entries to the Competition and an agent (Main Agent) for dealing directly with your entries (Participants). For the avoidance of doubt your contract will be with the Promoter.

 

2.    When does the Competition start? It starts on 8 February 2012.

 

3.    When does the Competition Close? It closes on 29 February 2012.

 

4.    What is the Prize? There are two prizes, a Grand Prize and 50 Runners-up prize.

 

5.    What is the Grand Prize?  If you win the Grand Prize you win a holiday comprising a return flight from any main UK Airport (including the Isle of Man) to Cyprus as the Grand Prize Winner and one other person of the your choice, transfers and 7 nights all-inclusive at Vangelis Apartments including all meals, snacks and alcoholic drinks. The person who accompanies the Grand Prize Winner can be under 18 years of age.

 

6.    What is the Runner-Up Prize? The Runners-up all receive a voucher for a £75 discount for a minimum of two adults on a 3 night city break chosen from any Thomas Cook brochure.

 

7.    How Can I enter the Competition? If you enter this Competition you will be bound by these Terms and Conditions found at the tills in store at Poundland Limited and online at www.neutradol.com/competition.html.

 

8.    Am I eligible to enter this Competition?  The Competition is open to residents in England, Scotland and Wales only (Territory) who are aged 18 or over at the time of entering this Competition, except for employees of M S George Limited, their families, agents or any professions involved in or connected with this Competition.

 

9.    How do I enter this Competition? (i) You can only enter this Competition by post; (ii) to enter this Competition, you may purchase any products in Poundland from the range of Neutradol products including Original Gel Odour Destroyer, Room Spray Odour Destroyer and the  Super Fresh, Bathroom,  Original or Deofab (Neutradol Products) ; (iii) once you have purchased a Neutradol Product, please complete the entry form available at Poundland (Entry Form) by inserting your name, address, telephone number and where you purchased the Neutradol Product; (iv) once you have correctly completed the Entry Form by following the instructions on the Entry Form, please send the completed Entry Form by post along with your Poundland receipt as proof of purchase of a Neutradol Product to “Win a holiday” Neutradol Competition, PO Box 504, Leicester, LE94 0AE. All valid entries will be entered into the random draw of this Competition to reveal the Grand Prize Winner and Runners-Up by the Independent Judge after the Closing Date Prize Draw (Prize Draw).

 

10.    Are there any Restrictions on me entering this Competition? Yes (i) you can only enter this Competition if you have purchased a Neutradol Product from Poundland; (ii) Your entry into this Competition is limited to where Participants live, and Participants must live in the Territory to participate in the Competition; (iii) only one entry is permitted per person; (iv) any entries into this Competition received after the Closing Date will not be accepted (v) no photocopies of Entry Forms or Poundland receipts will be accepted; (vi) incomplete Entry Forms or Entry Forms not in accordance with the instructions stipulated on the Entry Forms will be rejected; (vii) no applications from agents, third parties or organised groups will be accepted; (viii) the Promoter does not accept responsibility for entries lost, damaged or delayed in the post; (ix) proof of posting is not proof of receipt; (x) the Promoter reserves the right to cancel this Competition without notice in the event of the occurrence of circumstances beyond the Promoter’s control.

 

11.    How would I know whether I have won? (i) All entries will be sent to the Specialist Handling Company and an Independent Judge will select the Grand Prize Winner and the 50 Runners-Up; (ii) the Prize Draw will be conducted by an Independent Judge after the Closing Date; (iii) there is a total of one Grand Prize to be won and 50 Runner-Up Prizes; (iv) the Grand Prize Winner will be the first entry drawn at random by the Independent Judge from all valid entries received by the Closing Date. The next 50 entries drawn at random by the Independent Judge will be Runners-Up; (v) the Grand Prize is a holiday comprising a return flight from any main UK Airport (including the Isle of Man) to Cyprus for the winner and one other person of the winner’s choice, transfers and 7 nights all-inclusive at Vangelis Apartments; (vi) each Runner-Up Prize consists of a holiday voucher worth £75 for a minimum of two adults for a 3-night stay for a city break to be chosen from Thomas Cook’s brochures.

 

12.     Are there any Restriction on Prizes?  Yes. (i) The holiday must be taken by the Grand Prize Winner by no later than 30th November 2012; (ii) the holiday is subject to availability of flights and accommodation as purchased by the agent supplying the holiday; (iii) the Grand Prize does not include travel between the Grand Prize Winner’s home and the UK airport and incidental expenses are not included in the Grand Prize and will be the responsibility of the Grand Prize Winner.

 

13.    How do I claim the Prize? Once the Prize Draw has taken place the details of the Grand Prize Winner will be sent by the Specialist Handling Company to the Main Agent who will write to the Grand Prize Winner for verification of identify by requesting a copy of the person’s passport, date of birth and full names as on the passport and for three alternative dates that the person may be able to travel.  The first date being the first choice. In addition the Main Agent would inform the Grand Prize Winner that he or she has won and asking the Grand Prize Winner to reply and to confirm acceptance of the Grand Prize and to agree to his or her details being forwarded to Thomas Cook Travel Rewards in order to contact him or her to arrange the holiday. The details of the Grand Prize Winner will not be sent to Thomas Cook without the written consent of the Grand Prize Winner.

 

14.    Details of the Prize Draw (i) The Grand Prize Winner will be notified in writing by the Main Agent that he or she has won the Grand Prize within 3 days of the Closing Date; (ii) for the avoidance of doubt, on acceptance of the Grand Prize, the Grand Prize Winner agrees and accepts that Thomas Cook Travel Rewards can contact the Grand Prize Winner to arrange the holiday; (iii) all Runners-Up Prizes will be sent by the Main Agent directly to the Runners-Up by post with instructions on how to contact Thomas Cook directly to redeem against holiday bookings.

 

15.    Are there any Restrictions on Prize Draw? Yes. (i) There is no cash alternative to the Grand Prize and/or the Runners-Up Prize ; (ii) the Grand Prize or the Runners-Up Prize is non-refundable and non-transferable; (iii) the Promoter reserves the right to substitute the Grand Prize or Runners-Up Prize (or any part thereof) for a prize of equivalent monetary value if this is necessary for any reason; iv) if the Grand Prize Winner or a Runner-Up is unable or does not want, for whatever reason, to accept the Grand Prize or the Runners-Up Prize respectively, the Promoter reserves the right to award the prize to another eligible Participant; (v) the Grand Prize is subject to the following restrictions and/or exclusions (a) it excludes Bank Holidays; (b) it is subject to availability of flights and accommodation as purchased by the agent supplying the holiday on any particular date; (c) travel to UK airports or incidental expenses will not be included; and (d) in the event of any dispute between the Grand Prize Winner and the Promoter, the decision of the Promoter will be final.

 

16.     Are there any Restriction on the Grand Prize Winner? Yes. (i) Prior to departure the Grand Prize Winner must purchase comprehensive travel insurance either from the agent supplying the holiday or through his or her own source; (ii) the Grand Prize Winner or a Runner-Up may be required to participate in reasonable publicity arising from the promotion of this Competition.

 

17.    Are there any other Restrictions? Yes (i) By entering this Competition, the Grand Prize Winner and Runners-Up consent to the following (a) for their names to be disclosed to any person requesting that the Promoter confirm the identity of the Grand Prize Winner and/or the Runners-Up; (b) for the Promoter and Poundland to use their names and addresses for promotional or marketing purposes.(c) the names of the Grand Prize Winner and Runners-Up can be obtained by sending a written request enclosing a stamped self addressed envelope to M S George Limited, Merevale House, Parkshot, Richmond TW9 2RG, within ten weeks of the Closing Date; (d) the name of the independent judge can be obtained by sending a written request enclosing a stamped self addressed envelope to M S George Limited, Merevale House, Parkshot, Richmond TW9 2RG, within ten weeks of the Closing Date.

 

18.    Limitation of liability (i) To the maximum extent permitted by law, the Promoter shall not be liable for any damage, loss, injury or disappointment suffered by any Participant entering the Competition or as a result of any Grand Prize Winner and/or Runners-Up accepting the Grand Prize or the Runners-Up Prizes respectively (ii) nothing in these Terms and Conditions shall exclude or in any way limit the Promoter’s liability for fraud, death or personal injury caused directly by the Participant’s negligence, or any other liability to the extent such liability may not be excluded or limited as a matter of law or their servants, agents or employees. Subject to this (a) the maximum aggregate liability of the Promoter in contract, tort (excluding defamation), negligence, pre-contract or other representations or otherwise arising out of or in connection with these Terms and Conditions or the performance or observance of its obligations under these Terms and Conditions, and every applicable part of it shall be limited in aggregate to the value of the Neutradol Product(s) purchased by the Participants in entering this Competition (iii) save in respect of Clause 18(ii), the Promoter will not be liable to the Participants under these Terms and Conditions for any consequential losses such as loss of opportunity, loss of contracts or for any special, indirect or consequential loss or damage of any kind howsoever arising and whether caused by tort, breach of contract or otherwise, whether or not such loss or damage is foreseeable, foreseen or known.
 
19.    Data Protection and Confidentiality (i) The Promoter has notified the Information Commissioners Office in the United Kingdom for the purposes of the Data Protection Act 1998 and will comply with its provisions (ii) all personal data (where applicable from time to time) collected by the Promoter about the Participants are strictly confidential and, apart from being shared with Poundland, will not be shared with any other third party or except as required by law, and the Promoter and Poundland will only use personal data collected about the Participants in accordance with the Data Protection Act 1998; (iii) the Participants’ data used by the Promoter and Poundland will be stored in a database in accordance with the provisions of the Data Protection Act 1998; (iii) the Participants’ data may be used to inform the Participants of any offers or news from the Promoter and/or Poundland.  In the event that the Participants do not wish the Participants’ data to be used in this manner, the Participants may opt-out by ticking the opt-out box on the Entry Form.

 

20.    Entire agreement and severability (i) These Terms and Conditions from time to time constitute the entire understanding between the parties with respect to the subject matter of these Terms and Conditions and supersede all prior terms and agreements between the parties relating to it; (ii) if any clause of these Terms and Conditions is held invalid or unenforceable, the clause shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of the parties, and the remaining clauses shall remain in full force and effect.

 

21.     Waiver: The failure to exercise or delay in exercising a right or remedy under these Terms and Conditions shall not constitute a waiver of the right or remedy or a waiver of any other rights or remedies and no single or partial exercise of any right or remedy under these Terms and Conditions shall prevent any further exercise of the right or remedy or the exercise of any other right or remedy.  

 

22.    Jurisdiction and choice of law: These Terms and Conditions shall be governed by the laws of England and Wales and Participants agree to submit to the exclusive jurisdiction of the English courts.
